End-User License Agreement

This End-User License Agreement (“Agreement”) is a legal agreement between you and Mesorahs Miriam (“we,” “our,” or “the school”) governing your access to and use of the website at mesorahsmiriam.org (the “Site”).

By accessing or using the Site, you agree to be bound by this Agreement. If you do not agree, please do not use the Site.

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial informational purposes.

This license does not include any right to resell, redistribute, or otherwise commercialize the Site or its contents.

All content on the Site — including text, images, logos, graphics, design elements, and the Mesorahs Miriam name — is owned by or licensed to the school and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, modify, republish, upload, post, transmit, or distribute any content from the Site without our prior written permission, except for personal, non-commercial viewing.

You agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable law
• Attempt to gain unauthorized access to any part of the Site or to any related systems or networks
• Interfere with, disrupt, or place an undue burden on the Site or its infrastructure
• Use any automated means (bots, scrapers, crawlers other than standard search engine indexing) to access or collect content from the Site
• Impersonate any person or misrepresent your affiliation with any person or organization
• Upload or transmit viruses, malicious code, or any other harmful material through the Site

The Site may contain links to third-party websites or services, including our separate application system at app.mesorahsmiriam.org. We are not responsible for the content, policies, or practices of those third parties. Your use of any third-party site or service is at your own risk and subject to its own terms.

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any defects will be corrected. Information on the Site is provided for general purposes only and may not be current or complete.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MESORAHS MIRIAM, ITS EMPLOYEES, DIRECTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SITE.

This limitation applies regardless of the legal theory on which any claim is based.

You agree to indemnify and hold harmless Mesorahs Miriam and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Site or your violation of this Agreement.

We may suspend or terminate your access to the Site at any time, for any reason, without notice. Upon termination, all rights granted to you under this Agreement will immediately cease.

We may update this Agreement from time to time. When we do, we will update the effective date above. Continued use of the Site after changes take effect constitutes acceptance of the updated Agreement.

This Agreement is governed by and construed in accordance with the laws of the State of New York, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to this Agreement or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Rockland County, New York.
